General Terms
The following are the terms and conditions for the sale of products by ProteoSource LLC dba Silicon Valley Test and Measurement (“SVTM”). Please read this agreement carefully. Any different or additional terms set forth in customer’s purchase order or similar communication are objected to and shall not be binding on the company unless a separate agreement has been signed by an authorized officer of the company. By submitting your order, you agree to abide by these Terms and Conditions. You also acknowledge that you have read, accept, and agree to abide by our Return Policies.
We reserve the right to decline your order at our sole discretion which can occur if the goods are unavailable, if pricing is in error, if there are problems concerning credit or if fraud is suspected among other reasons. We will contact you if your order is declined or if we need more information. If we decline your order, we will refund any amount charged as a result of that order by the same means in which payment was received.
Payment
We process all payments through Paypal unless other arrangements are made in advance of order placement. You may make payment either with a credit card (VISA, MasterCard, American Express or Discover) or use your Paypal account. You do not need a Paypal account nor do you need to create one to complete your purchase. We collect Washington sales tax on products shipped to Washington addresses. Customer is responsible for all other taxes or duties.
Delivery and Title
Customer is responsible for all shipping costs and any applicable surcharges. Title and risk of loss pass to customer upon delivery of the products to the carrier. SVTM is not liable for delays in delivery.
Return Policies
We offer a 5-day right of return on all used equipment. Simply notify us within 5-days of receipt of the equipment and return the equipment according to the Return Procedure below for a full refund of product purchase price and applicable sales tax.
Items Ordered in Error – We will accept returns of items ordered in error if notified within 14 days of receipt subject to a 20% restocking fee provided the Return Procedure is followed.
Damage in Shipment – If your product arrives damaged you should contact the carrier immediately and contact us within 2 days of delivery at the destination address. Please note that delays can result in denied claims. Externally visible damage should be noted with the carrier upon delivery if possible. Photos of any damage are extremely helpful.
Return Procedure – Please contact us for a Return Materials Authorization (RMA) prior to shipping any goods back to us. Shipments received without an RMA may be refused or assessed a restocking fee of 20%. Once an RMA is issued, return shipment must be initiated by a traceable method, prepaid and insured for the purchase price within 7 days. Please mark the RMA number on the packing label. Customer is responsible for return shipping costs. Returned products must be in original condition and not altered in any way. All accessories, packaging, manuals, documentation and calibration certificates should be undamaged, unaltered and included with the unit. Credit will be issued upon inspection of the returned item. Shipping costs are non-refundable except when return is due to our error.
Warranties
Unless otherwise indicated all of our equipment is covered by our 90-day warranty. If a product should fail due to normal usage within 90-days following shipment we will, at our sole discretion, repair, replace the item or refund the product purchase price. Warranty covers product function only and excludes cosmetic issues, calibration costs and shipping expenses. Please follow product return procedures including obtaining a RMA. Please note that our warranty does not extend to further transshipment of our product after delivery to customer since damage can occur which are not the result of normal usage.
Use of Products
Our products are not authorized for use in critical safety or other applications where a failure may reasonably be expected to result in personal injury, loss of life, or catastrophic property damage. If customer uses or sells the products for use in any such applications, Customer acknowledges that such use or sale is at customer’s sole risk. Customer will indemnify, defend and hold SVTM and the product manufacturer harmless from and against any and all liabilities and costs arising out of or in connection with such use or sale. SVTM makes no warranty for merchantability or fitness of our products for any particular purpose.
LIMITATION OF LIABILITY
PROTEOSOURCE LLC DBA SILICON VALLEY TEST & MEASUREMENT (SVTM) IS NOT LIABLE FOR AND CUSTOMER IS NOT ENTITLED TO ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES; FOR EXAMPLE, LOSS OF PROFITS OR REVENUE, LOSS OF DATA, LOSS OF USE, REWORK, MANUFACTURING EXPENSE, INJURY TO REPUTATION, OR LOSS OF CUSTOMERS. CUSTOMER’S RECOVERY FROM SVTM FOR ANY DIRECT DAMAGES WILL NOT EXCEED THE PRICE OF THE PRODUCT AT ISSUE.
